EPP2 Exemption and Permit Criteria

Environment Agency Permits 

As of January 2015, new regulations apply to all sewage installations in England, but NOT in Wales or Scotland. This is in the form of a reform of the regulatory system to control small sewage discharges from septic tanks and small sewage treatment plants in England and comprises of General binding rules for small sewage discharges (SSDs) with effect from January 2015. Under these rules, it may be no longer mandatory for you to register for a Discharge Exemption. In Scotland and Wales, you still need to register your Sewage Discharge,. In Scotland you need to contact SEPA and in Wales, Natural Resources Wales.

There are different types of Environment Agency Discharge Permits that you are available under the EPP2 Regulations:

Discharge Exemption - No registration or Permit Required

If you are discharging:

  • Less than 5m3 per day to surface water (ditch, stream, etc.)
  • Less than 2m3 per day to ground 

Criteria for the above

  • No trade waste
  • No available connection to a foul sewer within 30 metres
  • EN 12566 Certified product
  • Product must be maintained and/or emptied by a suitably qualified person as per the manufacturers manual
  • Watercourse - must not run dry in summer
  • No discharge within 1 km of bathing waters, SSSI etc if you are discharging to surface waters
  • Your installation must comply with the Environment Agency General Binding Rules.

Standard Permit

If you are discharging:

  • 5-20m3 per day to surface water (ditch, stream, etc.)

Criteria for the above:

  • Secondary treated effluent only ( sewage treatment plant NOT a septic tank )
  • No trade waste
  • No available connection to a foul sewer within 30 metres
  • The Product must have an EN 12566 Certificate
  • Product must be maintained by a suitably qualified person as per the manufacturers manual
  • Watercourse must have a Dilution ratio of 8:1 – Does not run dry in summer
  • No discharge within 1 km of bathing waters, SSSI etc 

Bespoke Permit

If you don’t meet one or more of the criteria above 

If you are discharging:

  • More than 20m3 per day to surface water (ditch, stream, etc.)
  • More than 2m3 per day to ground
